Federal Consistency review under the Coastal Zone Management Act



Any Federal activity occurring within any area in Delaware may be subject to this review (i.e. Federally funded projects, or projects on behalf of a Federal Agency)

Projects that require a federal permit to be issued may be subject to Federal Consistency review, which requires that projects conducted by a federal agency, projects authorized by a federal permit and some projects implemented with federal funds be consistent with Delaware’s Coastal Zone Management policies. Projects are reviewed by DCMP staff in coordination with other agencies. If projects are consistent with the policies, Federal Consistency “concurrence” is issued.

Indefinite. Some projects may require reissuance if the associated federal permit is reauthorized. For example, Army Corps of Engineers maintenance dredging permits expire every 10 years.
